Acceptable Use Policy
This Acceptable Use Policy ("AUP") outlines the rules and guidelines for using the products, services, and platform (collectively, the "Services") provided by Cactus Real Estate Software, Inc. ("Cactus," "we," "our," or "us"). All users ("you," "your," or "Customer") must comply with this policy to maintain the integrity, security, and lawful use of our platform.
By using our Services, you agree to this AUP. If you do not agree, you may not access or use the Services.
1. Prohibited Activities
You may not use the Services to engage in, promote, or facilitate activities that are illegal, harmful, abusive, or interfere with others' use of Cactus. Prohibited activities include but are not limited to:
1.1 Unlawful Use
- Violating any applicable laws or regulations (local, state, national, or international).
- Engaging in activities related to money laundering, terrorism, or other criminal conduct.
1.2 Security Violations
- Accessing accounts or systems without authorization (including attempting to probe or test security).
- Disrupting or interfering with the integrity, performance, or security of the Services or other users’ data.
- Uploading or distributing malware, viruses, worms, or any code designed to harm software, systems, or users.
1.3 Abuse of Services
- Using automated systems (e.g., bots, scrapers) to access the platform in a manner that degrades performance or evades rate limits.
- Attempting to reverse-engineer, decompile, disassemble, or otherwise discover the source code or algorithms.
- Creating or disseminating false or misleading outputs with the intent to defraud.
1.4 Harassment and Harm
- Harassing, threatening, abusing, or violating the rights of others.
- Sharing offensive, defamatory, discriminatory, or obscene content through the platform.
1.5 Intellectual Property Violations
- Infringing upon or misappropriating Cactus’s or any third party’s intellectual property rights.
- Uploading documents or content that you do not have legal rights to use.
2. User Responsibilities
You are responsible for:
- Ensuring all content you upload complies with this AUP.
- Keeping login credentials confidential and secure.
- Reporting any security vulnerabilities or suspected policy violations to Cactus at security@trycactus.com.
3. Enforcement and Consequences
Cactus reserves the right to monitor usage to enforce this AUP and investigate suspected violations.
If we determine that you have violated this policy, we may:
- Issue warnings or request corrective actions.
- Suspend or terminate access to the Services.
- Report violations to law enforcement if necessary.
We may remove any content we determine violates this AUP or applicable law, at our sole discretion.
4. Changes to This Policy
We may update this AUP periodically. If we make material changes, we will notify you via the Platform or email. Continued use after updates constitutes acceptance of the revised policy.
